Economic Expert Witness for Business Damages Case

Business damages usually involve comparing where a business was (e.g., its annual net income or market value) prior to alleged damages and extrapolating its condition over the business life cycle.  The approach that is easiest to defend at trial is applying standard forecasting procedures to the firm's history prior to the damaging event.  We then perform a similar analysis to predict where the business is going after the damaging event.  Having income information before and after the damaging event allows us to determine if the difference in the business income path is significantly lower after the alleged damaging event, and how long it will take the business to return to its pre-damage income path.  

Many analysts who are trained in accounting or other business disciplines base their damage estimates on a before/after analysis that fails to take into account other potential explanations for the alleged decline in income.  For instance, many businesses were already in decline and business owners are using an alleged damaging event to cash out their business.  Whether you represent the damaged business or the defendant, you will find it is easier to resolve disputes when evidence is objectively produced and analyzed.
